NY State

There are many laws and exceptions in NY State. Google and AI often bring up incorrect information confusion NY State with NY City. Also Laws have changed and might not be updated here.

These laws appear to me on the surface to be unconstitutional as as an American you have the right to bear arms, but again I'm not a lawyer and just because a law is unconstitutional, doesn't mean you won't be thrown in jail or face enormous legal bills.

The NY State law regarding knives

American Knife and Tool Institute seems to have the best information.

The biggest restrictions against knives is intent and possession of a "dangerous knife" that is a knife that's designed as a weapon.

Most important to read on knife legality in NYS 265.15.3 and .4

265.15.3
switchblade knife, pilum ballistic knife, metal knuckle knife, dagger, dirk, stiletto, ... is presumptive evidence of its possession by all persons occupying such automobile  


265.15.4
The possession by any person of any dagger, dirk, stiletto, dangerous knife or any other weapon, instrument, appliance or substance designed, made or adapted for use primarily as a weapon, is presumptive evidence of intent to use the same unlawfully against another.


Note that the town or city (ex. NYC) may have additional restrictions.

Off the top of my head the following are illegal and there's not much clear definition of the item.

  • Automatic knives

    Some knives are illegal based on intent. (Note that possession of the knife shows intent).

    A/O Assisted Opening Knives
    A dubious “memorandum decision by the New York Court of Appeals” in 2018 provides that an assisted opening knife may be considered a “switchblade.” See the below comments under “Assisted Opening.”

The possession by any person of any dagger, dirk, stiletto, dangerous knife or any other weapon, instrument, appliance or substance designed, made or adapted for use primarily as a weapon, is presumptive evidence of intent to use the same unlawfully against another.
